A Profession in the Republic of Turkey: Attorneyship

In order to resolve the disputes and conflicts between the foreigners and the Ottoman citizens that began and arose as of the commencement of the Tanzimat reform era, several special courts are established and several codes, including the commercial codes, are adopted directly from the west into the complex judicial system of Ottoman, that consisted of Sharia, as being the center of the system, customary law, religious groups’ law, the law of countries that joined etc. Although defence right and legal profession was introduced into the system in several forms within the process adaptation, the removal of the Sharia was necessary for the perfect implementation of the “Defence Institution” and the “Attorneyship Institution” into the system. Therefore, the legal profession and defence institution gained structural safeguards with the establishment of the Republic of Turkey. However, the conversion to the real “lawyer” is realized with the adoption of the Attorneyship Law in 1969. While this process is being examined in the article, three important portraits of the modern lawyer,;Ali Haydar Ozkent, Volf Çernis and Faruk Erem and several cases are being evaluated.
